1. Acceptance of Terms

By accessing or using BC Garage ("we", "us", "our"), including the website bcgarage.ca, vehicle listings, financing pre-approval requests, inspection bookings, warranty inquiries, and private seller posting tools (collectively, the "Services"), you agree to these Terms & Conditions. If you do not agree, do not use the Services.

2. About BC Garage

BC Garage is a British Columbia-focused marketplace and sales facilitation platform for clean-title vehicles. We help buyers and sellers connect, arrange financing, inspections, and warranty options, and—where applicable—support structured transactions that may involve temporary ownership for compliance and consumer protection purposes.

Unless expressly stated in a written bill of sale or agreement to which BC Garage (or its licensed partner dealer) is a party, listings may represent private sellers, partner dealers, or inventory we facilitate. Always read the listing details carefully.

3. VSA Compliance (British Columbia)

Vehicle sales in British Columbia are regulated. Where BC Garage or a licensed partner acts as a motor dealer or otherwise engages in regulated sales activity, we operate in accordance with the Motor Dealer Act and rules administered by the Vehicle Sales Authority of British Columbia (VSA), including applicable disclosure, advertising, and consumer protection requirements.

• Dealer or facilitated sales will include required disclosures where applicable (e.g. history, warranty status, fees).
• Advertised prices are in Canadian dollars (CAD) unless otherwise noted and may exclude taxes, licensing, and documented fees disclosed before purchase.
• Nothing on this website replaces mandatory VSA / ICBC / bill of sale documentation completed at the time of sale.

4. Clean Title Policy

BC Garage focuses on clean title vehicles. Sellers and listing partners represent that a vehicle is not salvage, rebuilt, irreparable, or otherwise branded in a way inconsistent with a clean title under applicable Canadian / BC standards, unless clearly disclosed.

Misrepresentation of title status is grounds for immediate removal of a listing and may result in liability to the seller. Buyers should still perform independent title and history checks (e.g. ICBC, Carfax / equivalent) before purchase.

5. Temporary Ownership & Facilitated Transactions

In some transactions, BC Garage or a licensed partner may take temporary ownership of a vehicle to facilitate a compliant sale (for example, to enable financing, complete required inspections, process transfer paperwork, or meet VSA / dealer process requirements). Temporary ownership is administrative and transactional—not a long-term acquisition for inventory unless separately agreed.

• Timing, documentation, and any fees related to temporary ownership will be disclosed before you commit.
• Title and registration processes follow ICBC and applicable BC law.
• Risk of loss and insurance obligations during temporary ownership will be addressed in the transaction paperwork.

6. Vehicle Inspection — $200 Fee

BC Garage offers or coordinates professional vehicle inspections to support buyer confidence. Unless a written promotion states otherwise:

• The standard inspection fee is $200 CAD (plus applicable taxes if any).
• Inspection scope (mechanical, safety, cosmetic) depends on the package selected and the inspector engaged.
• An inspection is an opinion based on visible / tested condition at a point in time; it is not a guarantee against future failure or a substitute for a full manufacturer warranty.
• Fees for inspections are generally non-refundable once the inspection has been performed or the inspector has been dispatched, except where required by law or if we cancel.

7. Financing

Pre-approval and financing tools on BC Garage help estimate budget and connect you with lenders or financing partners. Important rules:

• BC Garage is not itself a bank or credit union. Approvals, rates, and terms are determined by the lender.
• Sample monthly payments on vehicle pages are estimates only (illustrative APR and term) and are not offers of credit.
• Financing may require credit checks, proof of income, down payment, insurance, and vehicle eligibility (including clean title status).
• You authorize us to share your pre-approval information with financing partners for the purpose of assessing options.

8. Warranty

Optional extended warranties or protection products may be offered through third-party providers or partners. Warranty coverage, exclusions, deductibles, claim procedures, and cancellation rights are governed solely by the warranty contract you receive at purchase—not by website marketing copy.

Unless a specific written warranty is purchased or required by law, vehicles may be sold "as is" to the extent permitted in British Columbia.

9. Private Sales & Seller Listings

Private sellers may post vehicles without creating an account. By submitting a listing you represent that:

• You have authority to sell the vehicle.
• Information and photos you provide are accurate.
• The vehicle meets our clean-title policy.
• You will complete ICBC transfer and legal sale steps properly when a buyer is found (or through our facilitated process if selected).

BC Garage may edit, refuse, or remove listings at its discretion (including incomplete, unsafe, or non-compliant listings). For pure private party sales where we are not a party to the contract, buyers and sellers remain responsible for due diligence, payment security, and legal transfer.

10. Fees & Pricing

• Private seller posting on BC Garage is currently free unless we announce otherwise.
• Standard vehicle inspection: $200 CAD.
• Financing placement, documentation, preparation, or dealer fees (if any) will be disclosed in writing before you finalize a purchase.
• Taxes, ICBC insurance, and government fees are extra unless expressly included.

11. User Conduct

You agree not to misuse the Services, post fraudulent listings, harass other users, scrape the site, or attempt to circumvent security or VSA / consumer protection requirements.

12. Privacy

We collect contact and application information you submit (name, email, phone, vehicle interest, financing details) to respond to inquiries and process services. Public site contact appears as RSBautosales@gmail.com. Lead handling is performed by our operations team. Do not submit sensitive financial account numbers through general web forms.

13. Intellectual Property

BC Garage branding, design, and original site content are owned by us or our licensors. Listing photos and descriptions you submit grant us a non-exclusive licence to display and promote the listing on the Services and related marketing.

14. Disclaimers & Limitation of Liability

The Services are provided "as is" to the fullest extent permitted by law. We do not warrant uninterrupted availability of the website or that inventory descriptions are error-free. To the maximum extent permitted under British Columbia law, BC Garage is not liable for indirect, incidental, special, or consequential damages arising from use of the Services or from transactions between users. Our aggregate liability for any claim relating to the Services is limited to the greater of (a) fees you paid us for the specific service giving rise to the claim in the prior 90 days, or (b) $200 CAD.

Nothing in these Terms excludes liability that cannot be excluded under applicable consumer protection or motor dealer legislation.

15. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Exclusive venue for disputes is the courts of British Columbia, subject to any mandatory VSA or consumer complaint processes.

16. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use of the Services after updates constitutes acceptance of the revised Terms.
